These terms (Terms) cover the use of the BMO Rainbow Deposits campaign (Program) website and all related features and functionality (Website).

You accept these Terms by submitting a photo to the Program and/or through your access of the Website.

General:

  1. Photo submissions to the Program will be accepted from June 1, 2026 to August 31, 2026 (Program Period).
  2. Bank of Montreal (BMO) will donate $1 CAD to Rainbow Railroad (401 Richmond Street West, Toronto, ON, M5V 3A8, Canada) for each photo of a rainbow submitted to the Website (Rainbow Photo) during the Program Period. Donations will be made by BMO in Canadian dollars, up to a maximum of $50,000 CAD / $36,475 USD. Based on a CAD/USD exchange rate of $1 CAD / $0.73 USD. This amount may vary as exchange rates are subject to change at any time.
  3. BMO reserves the right to amend, suspend or cancel this Program in any way, at any time, for any reason whatsoever as determined by BMO in its sole and absolute discretion.
  4. Rainbow Railroad (opens an external link in a new tab) is a third party unaffiliated with BMO. This Program is not sponsored or administered by Rainbow Railroad. Any questions or comments regarding the Program must be directed to BMO.
  5. Links from this Website to websites not under the control of BMO are provided solely for the convenience of visitors to the Website in connection with the Program and do not imply the endorsement or approval of such third party websites, products or services. Third party websites may have privacy, security and other terms of use that differ from BMO's. When visiting third party websites, please review the privacy and security policies applicable to those websites.

License and Consent:

  1. By submitting a Rainbow Photo to the Program, you:
    • grant to BMO and its affiliates, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the Rainbow Photo, in whole or in part, for advertising or promoting the Program or for any other reason, in any form of media, including social media;
    • waive all moral rights in and to the submitted Rainbow Photo in favour of BMO (and anyone authorized by BMO to use such Rainbow Photo);
    • represent and warrant that the Rainbow Photo submitted to BMO:
      • is original to you and/or you have obtained all necessary rights in and to such Rainbow Photo for the purposes of submitting such Rainbow Photo to BMO;
      • does not violate any law, statute, ordinance or regulation;
      • does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;
      • will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party;
    • agree that any and all materials created by BMO that incorporate the Rainbow Photo will remain the sole and exclusive property of BMO and that you will not receive any royalty, compensation or other benefit in connection with the Rainbow Photo; and
    • release BMO from all claims including, without limitation, claims based upon invasion of privacy, defamation, or right of publicity arising out of any use of the Rainbow Photo.
  2. BMO reserves the right to screen all Rainbow Photos and to take any action it deems necessary based on the circumstances, including decisions related to the publication of photos on the Website.

Privacy:

  1. Each user of the Website expressly consents to BMO storing, sharing and using the personal information submitted for the purpose of administering the Program and in accordance with BMO's Privacy Code, available at bmo.com/privacy (opens an external link in a new tab). This section does not limit any other consent(s) that an individual may provide BMO or others in relation to the collection, use and/or disclosure of their personal information.
